A loophole of particular interest to the real estate investor is the 1031 Tax Deferred Exchange.  The 1031 Exchange allows a Seller to defer capital gains tax recognition and carry forward their basis on the sale of appreciated investment property where replacement like-kind property is acquired within the statutory period.  The 1031 Exchange allows deferment until some future time when the replacement like-kind property is sold in a taxable exchange.  There are four types of 1031 Exchanges:

 

  • The Simultaneous Exchange;
  • The Forward Delayed Exchange;
  • The Construction Exchange; and
  • The Reverse Exchange.
